These Terms & Conditions (“Terms”) govern all services provided by Edgar Hidalgo (“Provider,” “Interpreter,” “Consultant,” “Trainer,” or “Expert”), including legal, medical, immigration, business, social services, remote interpreting, translation, consulting, training, educational services, and expert witness work, as described in the published Services Section. By engaging any of these services, the client (“Client”) agrees to these Terms in full.These Terms apply to all service formats, including in-person, remote, written, telephonic, video, consulting, training, expert analysis, program development, and speaking engagements.1. Nature of Services & Professional Role
Interpreters and translators do not provide legal, medical, financial, or professional advice.
The Interpreter converts spoken or written messages without adding, omitting, modifying, or explaining content beyond professional interpreting standards.
All interpreting and translation services are performed according to professional codes of ethics, confidentiality obligations, and the standards applicable to the service setting.
The Interpreter is not responsible for how the Client or third parties use, interpret, rely on, or apply the interpreted or translated content.
2. Limitations of Liability
To the fullest extent permitted by law:
The Provider is not liable for:
Legal outcomes, rulings, or judicial decisions
Immigration outcomes, USCIS decisions, or denials
Medical decisions, treatments, diagnoses, or clinical outcomes
Corporate, HR, disciplinary, or administrative consequences
Business, financial, or contractual outcomes
Misuse, misapplication, or misunderstanding of interpreted or translated information
Services do not guarantee any legal, immigration, academic, corporate, or regulatory outcome.
3. Confidentiality & Data Security
All services are delivered according to confidentiality rules, including HIPAA, Title VI, ADA, and court-mandated standards, where applicable.
The Provider maintains strict confidentiality of all information obtained during the assignment.
The Provider is not responsible for data breaches, recording, interception, or unauthorized disclosure caused by:
Client-side technology
Client Wi-Fi or hardware
Client’s chosen communication platform
Third-party participants added by the Client
Clients are responsible for ensuring that any remote platform used is acceptable to their institution or agency.
4. Client Responsibilities
Clients agree to:
Provide accurate and complete information
Provide necessary documents in advance when required
Ensure professional, safe working conditions for in-person assignments
Provide adequate technological support for remote sessions
Notify the Provider promptly of any changes
Failure to comply may affect service effectiveness and may result in fees or discontinuation of service.
5. Payment Terms, Deposits & Cancellations
Deposits: Some assignments require a non-refundable deposit at the time of booking.
Local Assignments: Cancellations must occur at least 48 hours in advance.
International or Out-of-State Engagements: Require at least one week notice for cancellation.
Late cancellations, last-minute schedule changes, or no-shows may incur full or partial fees depending on the assignment.
Refunds: Cancellations after deadlines may not qualify for refunds.
Payment Deadlines:
All invoices must be paid no later than 30 days after service is fulfilled.
Some assignments may require payment upon completion, at the Provider’s discretion.
Late Payments: May be subject to fees or suspension of future services.
6. Remote Interpreting Conditions (VRI & OPI)
The Provider is not liable for service interruptions caused by:
Internet outages
Hardware or software failures
Platform instability
Environmental noise or disruptions on the Client side
Clients understand that remote interpreting may not be appropriate for certain high-risk or highly technical environments, and the Client assumes responsibility for determining suitability.
7. Translation Services
Certified translations include a certificate of accuracy, but the Provider cannot guarantee acceptance by courts, agencies, or institutions, including USCIS.
Clients are responsible for verifying the specific requirements of their requesting institution before commissioning translation.
Translations are intended only for the stated purpose requested by the Client and may not be repurposed without written approval.
8. Consulting, Compliance & Policy Services
Language access consulting, compliance guidance, terminology development, and program-design services do not guarantee institutional compliance, risk elimination, or regulatory approval.
The Provider’s recommendations must be implemented properly by the Client; failure to do so voids any implied assurance of results.
9. Training, Educational Services & Certification Prep
Training, coaching, workshops, master classes, and certification preparation services aim to support skill development.
The Provider does not guarantee:
Passage of any certification exam
Credentialing outcomes
Improvement without practice and active participation
Unauthorized recording, downloading, copying, or sharing of training material is prohibited.
10. Intellectual Property
All training materials, glossaries, presentations, workshops, videos, recordings, translations, course content, and written materials are the intellectual property of the Provider.
Clients agree that they will not:
Record any session without written permission
Reproduce or distribute materials
Sell, publish, or share content privately or publicly
Violations may result in legal action.
11. Expert Witness Services
The Provider’s expert analysis, reports, declarations, and testimony are independent professional opinions and cannot be influenced or altered by Client expectations.
Expert witness fees are owed regardless of case outcome.
Reports, transcripts, and analyses may not be altered, edited, or used outside the stated legal purpose without written consent.
Unauthorized disclosure to third parties is prohibited.
12. Rescheduling
Rescheduling is subject to availability. The Provider is not required to accommodate rescheduling requests, especially for last-minute or conflicting engagements.
13. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
14. Dispute Resolution
Mandatory First Step: Arbitration
Any dispute arising from these Terms must first be resolved through binding arbitration conducted in California.
If Arbitration Fails
If arbitration does not resolve the matter or either party fails to comply with the arbitration award, the parties may pursue litigation in a court of competent jurisdiction.
Each party is responsible for its own legal fees unless otherwise awarded.
15. Acceptance of Terms
By scheduling, commissioning, or using any service described herein, the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
